Video Depositions from Qualified Deposition Reporters


In the past, if a witness was unavailable to testify at trial, the court would simply not hear that testimony. Facts lived only with the witness; it was impossible for anyone, even a court stenographer, to accurately report and reproduce every detail of a witness and his or her testimony. However, thanks to recent technological advances, video depositions are rapidly becoming an accepted and widely used substitute for a witness kept from testifying.

Video depositions, made in the presence of a court stenographer and with the witness properly under oath, accurately represent every aspect of the witness that could have been seen in court. When properly presented, video depositions taken in the presence of quality deposition reporters and videographers are just as effective as live testimony. Video depositions allow the Court and jury to see the witnesses’ demeanor and pick up on body language that can’t be seen in a transcript.

Video depositions aside, the visual technology is an excellent tool to assist any court reporter with documenting any testimony. As he or she is observing the deposition proceedings, the court reporter may find it difficult to understand a particular part of the testimony due to the witness' soft or heavily accented voice. If the court stenographer has a videographer taking video of the testimony, he or she can review it and gain a better understanding of what it was that the witness said.
