Background

Case Background: No. 337–TA–1139 /Patent Infringement of Juul Device

The Commission launched an investigation based on a complaint filed by Juul Labs, Inc. (Juul), styled Certain Electronic Nicotine Delivery Systems and Components Thereof (337-TA-1139), which related to e-cigarettes and packaging. Specifically, Juul alleged violation by way of unlawful importation into the US., sell for importation, and/or sell within the U.S. after importation of electronic nicotine delivery systems and components thereof that infringe one or more claims of U.S. Patent Nos. 10,070,669; 10,076,139; 10,045,568; and 10,058,130.

 

     Case Outcome

    The Commission ultimately found a violation of Section 337 and issued limited exclusion orders and cease-and-desist     orders directed to two remaining respondents.

 

Case Background: No. 337–TA–1141 /Patent Infringement of Juul Pods

Juul filed a second ITC complaint in November 2018 against more than 20 companies accused of selling copycat Juul pods in the US. Juul said the pods infringed patents and targeted flavors that appealed to underage users. The complaint alleges that the Respondents unlawfully import into the U.S., sell for importation, and/or sell within the U.S. after importation of certain cartridges for nicotine vaporizers and components thereof, such as the mouthpiece, storage compartment, and heater, that infringe one or more of claims of U.S Patent No. 10,058,129; 10,104,915; 10,111,470; 10,117,465 and 10,117,466.

 

     Case Outcome

    The ITC prohibited the companies from selling or importing into the US nicotine cartridges alleged to infringe Juul     patents.

Conclusion
Digital Evidence Group, a Huseby company, successfully supported outside counsel and their client, JUUL Labs Inc., in two ITC cases involving the design of the JUUL vaping system and its nicotine delivery pods. In the process of defending their intellectual property rights, DEG provided 3D animations that were used at both hearings to depict the unique design of the JUUL device and pods. The animations provided to JUUL highlight each innovative feature of the JUUL device and cartridge and depict why their protected patents should be enforced against copycat products flooding the market to cash in on the top-selling e-cigarette manufacturer.
